On 25 September 2009 Chief Justice Black issued a new
Practice Note
to govern the use of technology in the Federal Court. This document entitled
"Practice Note CM 6 – Electronic Technology in Litigation”
replaces the former Practice Note 17 issued in January 2009.
This new Practice Note sets out a framework for the use of electronic documents in
proceedings before the Federal Court and has been designed to increase efficiency and to facilitate a more effective exchange of documents
between parties. The framework outlined by the court will change the way many businesses and law firms conduct their document management
and discovery processes with the requirement to consider related technologies early in a proceeding.
